1. Acceptance of Terms

By creating an account, logging into Quiz Master Kenya, or using any part of our platform ("the Platform", "we", "our service"), you automatically and unconditionally accept and agree to be bound by these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you and Quiz Master Kenya Ltd., a company registered in Kenya.

Agreement to Terms: Your use of the platform—including creating an account, logging in, browsing quizzes, or participating in any quiz session—constitutes your acceptance of these terms. If you do not agree to these terms, you must immediately stop using our service and delete your account.

For schools and educational institutions: By signing up your organization, you represent that you have the authority to bind your institution to these terms.

2. Description of Service

Quiz Master Kenya is an interactive quiz and student engagement platform designed for Kenyan schools, teachers, and students. Our services include:

• Quiz Creation: Tools for teachers to create custom quizzes aligned with CBC curriculum
• Live Quiz Sessions: Real-time interactive quizzes with leaderboards and student engagement features
• Pre-built Quiz Library: Access to KPSEA, KJSEA, and subject-specific quiz banks
• Performance Tracking: Student progress reports, analytics, and performance insights
• Student Practice: Self-paced quiz practice for homework and exam preparation
• Classroom Management: Tools for organizing classes, tracking participation, and managing assignments

3. User Accounts and Responsibilities

Account Creation:

• You must provide accurate, current information when creating an account
• Teachers must use a valid email address and real name
• Students under 18 must have parent, guardian, or school consent to use the platform
• You are responsible for maintaining the confidentiality of your password
• You must notify us immediately of any unauthorized use of your account

Acceptable Use - You agree to:

• Use Quiz Master Kenya for lawful educational purposes only
• Not share your account credentials with others
• Not create quizzes with inappropriate, offensive, or harmful content
• Not cheat, manipulate scores, or help others cheat on quizzes
• Not attempt to hack, reverse engineer, or compromise the platform's security
• Respect other users' privacy and intellectual property
• Not use the platform to harass, bully, or harm other users

Prohibited Activities:

• Uploading viruses, malware, or harmful code
• Scraping or downloading content using automated tools without permission
• Impersonating other users, teachers, or administrators
• Using the platform for commercial purposes without our written consent
• Violating any applicable laws or regulations

4. Intellectual Property and Content Ownership

Quiz Master's Intellectual Property:

• The Quiz Master platform, including all software, code, design, branding, features, and functionality, is owned exclusively by Quiz Master Kenya Ltd.
• All quiz content and question banks available on the platform are protected by copyright and owned by Quiz Master Kenya Ltd.
• You may not copy, modify, reverse engineer, distribute, reproduce, or sell any part of our platform without our express written permission
• The Quiz Master name, logo, and all related trademarks are property of Quiz Master Kenya Ltd.

Content Generated Using the Platform:

• All quizzes, questions, and materials created using Quiz Master Kenya belong exclusively to Quiz Master Kenya Ltd.
• By using our platform to generate quizzes, you acknowledge that all content created becomes the property of Quiz Master Kenya Ltd.
• You grant Quiz Master Kenya Ltd. a perpetual, irrevocable, worldwide, royalty-free license to use, modify, reproduce, distribute, and display any content you create on the platform
• You represent that any content you input does not violate third-party intellectual property rights
• Quiz Master Kenya Ltd. has the right to use any generated quiz content for platform improvement, training, marketing, or any other purpose

Student Data and Performance Records:

Student quiz responses, scores, and performance data are retained by Quiz Master Kenya Ltd. for account purposes, performance tracking, and historical records. By using the platform, students and teachers agree that this data may be stored indefinitely to maintain educational records and improve our services.

5. Service Availability and Modifications

Service Availability:

• We strive to provide uninterrupted access to Quiz Master, but cannot guarantee 100% uptime
• Planned maintenance will be communicated in advance when possible
• We are not liable for service interruptions due to technical issues, internet outages, or force majeure

Right to Modify:

• We may update, modify, or discontinue features at any time
• We reserve the right to change pricing with notice to existing users
• Major changes will be communicated via email or platform notifications

6. Account Termination and Suspension

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent, abusive, or illegal activity
• Create inappropriate content or harass other users
• Fail to pay for premium services (if applicable)
• Compromise the security or integrity of the platform

You may delete your account at any time:

• Contact us at contact@quizmaster.co.ke to request account deletion
• Your personal data will be deleted in accordance with our Privacy Policy
• Quiz history and performance data may be retained for teachers' records

7. Subscription and Payment Terms

Quiz Master Kenya operates on a subscription-based model with various pricing tiers designed for different user needs.

Subscription Plans:

• Quiz Master offers different subscription levels with varying features and access levels
• Full access to all platform features requires a paid subscription
• Pricing is clearly communicated at the time of registration or upgrade
• Trial periods (if offered) have specific terms that will be communicated at sign-up

Payment Terms:

• Payments are processed securely through trusted Kenyan payment providers including M-Pesa and bank transfers
• Subscriptions renew automatically unless cancelled before the renewal date
• You are responsible for maintaining valid payment information
• Failure to pay may result in suspension or termination of your account
• Schools and institutions may negotiate custom enterprise pricing and payment schedules

Refund Policy:

• Refund requests must be submitted within 7 days of payment
• Refunds are evaluated on a case-by-case basis and are at the sole discretion of Quiz Master Kenya Ltd.
• No refunds will be issued for partial subscription periods or unused portions of subscriptions
• Technical issues or service interruptions do not automatically qualify for refunds

8. Disclaimers and Limitation of Liability

Educational Tool Disclaimer:

• Quiz Master is an educational technology tool, not a substitute for quality teaching
• We do not guarantee specific learning outcomes or exam results
• Teachers are responsible for verifying the accuracy of quiz content
• Quiz scores should be used as one of many assessment methods

Service Disclaimer:

Quiz Master Kenya is provided "as is" without warranties of any kind. While we strive for excellence, we cannot guarantee uninterrupted service, error-free operation, or complete accuracy of all content.

Limitation of Liability:

To the fullest extent permitted by Kenyan law, Quiz Master Kenya Ltd. shall not be liable for indirect, incidental, special, or consequential damages arising from your use of our service, including loss of data, lost profits, or service interruptions. Our total liability shall not exceed the amount you paid us in the past 12 months.

9. Governing Law and Dispute Resolution

Governing Law: These Terms of Service are governed by the laws of the Republic of Kenya.

Dispute Resolution:

• We encourage you to contact us first to resolve any issues informally
• If informal resolution fails, disputes shall be resolved through arbitration in Nairobi, Kenya
• Any legal proceedings must be brought in the courts of Nairobi
• You agree to the exclusive jurisdiction of Kenyan courts

10. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our practices, features, or legal requirements. When we make changes:

• We will update the "Last updated" date at the top of this page
• Significant changes will be communicated via email or platform notification
• Continued use of Quiz Master after changes means you accept the updated terms
• If you don't agree to new terms, you may delete your account

11. General Provisions

• Severability: If any provision of these terms is found invalid, the remaining provisions remain in effect
• No Waiver: Our failure to enforce any right doesn't constitute a waiver of that right
• Assignment: You may not transfer your account or these terms to anyone else without our consent
• Entire Agreement: These terms, together with our Privacy Policy, constitute the full agreement between you and Quiz Master Kenya
